Article 1 In order to implement the spirit of the Nineteenth National Congress of the Communist Party of China and regulate the discussion and decision of party members in the whole province, according to the "Articles of the Communist Party of China" and "Procedures for the Discussion and Decision of Party Groups on Disciplinary Matters (Trial)" and other relevant regulations, In accordance with the actual work, these rules are formulated.
Article 2 The party group (including party committees of the nature of the party group, the same below) shall conscientiously perform the main responsibility of administering the party strictly and strictly, and the disciplinary commission and supervisory commission shall be assigned to the discipline inspection and supervision team to perform their supervisory responsibilities seriously. Adhere to the party's need to govern the party and administer the party rigorously, adhere to equality before the party discipline, adhere to the principle of seeking truth from facts, adhere to punishment before and after, cure illness and save people, strengthen supervision and discipline accountability, and ensure that case processing achieves good political, disciplinary and social effects, and ensures cases Quality can stand the test of history and people.
Article 3 The party group shall implement party disciplinary sanctions against party members and cadres under its management, and shall make decisions in the name of the party group through collective discussion in accordance with the prescribed procedures. No individual or minority shall be allowed to decide and approve without authorization. The party's disciplinary decision takes effect from the date when the party group discusses the decision; if it should be reported to the party's disciplinary inspection committee at or above the county level for review and approval, it will take effect from the date of approval.
Article 4 The disciplinary inspection and supervision teams at all levels shall be assigned to the disciplinary inspection and supervision team (hereinafter referred to as the disciplinary inspection and supervision team) in accordance with the cadre management authority and relevant regulations. Carry out case review and internal trials. After collective research by the discipline inspection and supervision team, put forward preliminary suggestions for party discipline, communicate with the party team in the department and reach consensus, and then transfer the case to the same level discipline inspection and supervision work committee (hereinafter referred to as the discipline inspection and supervision work committee). Conduct trials; for sensitive special cases, report to the case trial department of the dispatching agency for review and put forward suggestions for handling. The disciplinary inspection and supervision work committee shall conscientiously perform the functions of audit control and supervision and restriction on the transferred cases, form a trial report after collective research, and feed it back to the disciplinary inspection and supervision team to ensure that the facts are clear, the evidence is accurate, the qualitative accuracy is correct, the processing is proper, the procedures are complete, Program compliance.
The disciplinary inspection and supervision work committee shall strengthen communication with the disciplinary inspection and supervision team in the trial process. The dispatched disciplinary inspection and supervision team shall, in principle, respect the opinions of the disciplinary inspection and supervision work committee. In case of differences, if the consensus cannot be reached through communication, the Discipline Inspection and Supervision Commission shall report the opinions of the two parties to the case trial department of the dispatching agency for review and put forward their opinions for feedback, and shall give feedback after approval by the responsible manager.
The dispatched disciplinary inspection and supervision team should strengthen communication with relevant parties, especially for cases of disciplinary violations by mid-level full-time party members and leading cadres managed by the party team in the department. The trial department fully exchanged opinions.
Article 5 After being examined by the Commission for Broker Inspection and Supervision, the Discipline Inspection and Supervision Team shall be sent to the Party Discipline Group of the department in charge of disciplinary suggestions. After the Party Group instructs the Party Committee or the Discipline Inspection Commission of the Institution to perform corresponding procedures in accordance with Article 42 of the Constitution of the Communist Party of China, Report to the party group to discuss the decision. After the party group makes a party disciplinary decision, it shall formally notify the dispatched disciplinary inspection and supervision group.
County party (city, district) Party committees approved the establishment of the party group to the party members and cadres under its management to expel the party registration, should be reported to the county (city, district) Commission for Discipline Inspection for approval.
Article 6 Disciplinary sanctions shall be given to party members and cadres stationed at or below the middle level (excluding the middle level), which shall be reviewed and tried by the party committees and disciplinary committees of the department, and the relevant procedures shall be implemented in accordance with Article 42 of the Constitution of the Communist Party of China. Determined by the party group. The party group shall solicit opinions from the discipline inspection and supervision team before discussing the decision.
According to the needs of the work, the dispatched disciplinary inspection and supervision team can directly review cases of party members and cadres in violation of party discipline that are stationed at or below the middle level of the department. After dispatched to the disciplinary inspection and supervision group for review and trial, they proposed party disciplinary measures and transferred them to the party committees and departmental disciplinary committees stationed in departmental organs to perform corresponding procedures in accordance with regulations, and the party group discussed and decided. When necessary, the stationed disciplinary inspection and supervision group may directly report the party's disciplinary suggestions to the party group stationed in the department for discussion and decision.
Article 7 If disciplinary sanctions are given to middle-level party members and cadres stationed in the management of departmental party groups, and party members or cadres below middle level (excluding middle ranks) are revoked from party positions or above, party disciplinary measures shall be effective from the date when the party disciplinary decision of the departmental organs takes effect. Within 30 days, the Party's disciplinary decision and related materials should be reported to the Discipline Inspection and Supervision Commission for record. The disciplinary inspection and supervision work committee shall carefully review the filing materials, and promptly report any problems and supervise the resolution.
The disciplinary inspection and supervision work committee shall submit a special report on the record of supervision to the dispatching agency and the party work committee at the same level, and may report at any time if necessary.
Where party discipline is imposed on party members and cadres filed with the party committees of provinces, cities, and counties, the party team stationed in the department shall notify the party discipline organization department at the same level of the party discipline decision.
Article 8 For cases of disciplinary violations by party members and cadres in the party organization of the competent department in which the party's organizational relationship is at the local level and the cadre management authority is in the competent department, the competent department's party group shall discuss and decide on the matter, and report to Local party committees and disciplinary committees report the results of the processing. Among them, those who hold the position of deputies to the local people's congresses should also report to the local people's congress standing committees; those who hold the positions of members of the local CPPCC should also notify the local CPPCC and the United Front Work Department.
For the above-mentioned cases that the local disciplinary commission first found and filed for review, accepted the designation of a higher-level disciplinary commission or negotiated with the local disciplinary inspection and supervision team (including the internal disciplinary inspection and supervision agency), the local disciplinary commission should make a party disciplinary decision in accordance with the procedures, and Report the results of the investigation to the responsible party group and the discipline inspection and supervision team (including the internal discipline inspection and supervision agency). The party's organizational relationship is not in the province, and the cadre's administrative competence is in the case of party members and cadres who are in charge of the party group of the competent department. Article 9 If the person being punished refuses to accept the party's decision on party discipline, he may file an appeal in accordance with the party constitution and relevant regulations.
Article 10 The disciplinary inspection and supervision work committee, under the leadership of the dispatching agency, establishes and improves the quality evaluation mechanism for disciplinary cases, supervises and inspects the party group's discussion and decision, and dispatches the disciplinary inspection and supervision group to review and deal with the factual evidence, nature determination, punishment grades, and procedures of the cases. Reporting and interviewing will be used to feedback the evaluation results.
Article 11 If the resident station has not established an organ disciplinary committee, the party committee of the organ shall handle relevant matters stipulated in these Detailed Rules; if there is no party committee of the organ, the party group shall designate other internal institutions to handle relevant matters.
Article 12 "Communication" as referred to in these Detailed Rules includes various methods, including written, verbal, and conference. The communication shall be filed and filed.
Article 13 "Perform corresponding procedures in accordance with Article 42 of the Constitution of the Communist Party of China" as stipulated in these Detailed Rules, including "ordinary procedures" and "special procedures".
"Ordinary procedure" refers to the disciplinary action against party members, which must be discussed and decided by the branch conference and reported to the Party's primary committee for approval.
"Special procedures" means that under special circumstances, party committees and disciplinary committees at or above the county level have the right to directly decide to impose disciplinary sanctions on party members. In any of the following cases, it shall be regarded as a special case and special procedures shall apply:
(1) Party members who are subject to disciplinary action when there is a problem of disciplinary disciplinary actions, whose work is more secretive, or whose secrets are involved in a higher level of secrecy, should not be discussed by grass-roots party organizations;
(2) Party members who have been subject to disciplinary issues should be given disciplinary action, the grassroots party organization where they are located is paralyzed, or the leaders of the grassroots party organization are directly involved in the problem of disciplinary issues;
(3) Party members who should be subject to disciplinary sanctions for disciplinary issues, whose grass-roots party organization refuses to deal with them or deliberately delays them;
(4) Party members who are subject to disciplinary action if there is a problem of disciplinary action, and the original grass-roots party organization in which they belong is revoked or merged and cannot be handled by the original grass-roots party organization and the new unit party organization;
(5) In the case of group violations of disciplines across regions and units, it is really necessary for the parties and organizations in these regions and units to jointly deal with them;
(6) In the case of various emergency situations, which need to be dealt with promptly;
(7) Other situations where party organizations at or above the provincial level believe that it is necessary to make a decision directly.
Article 14 The working organs of the Party and the leading organizations of the institutions directly under the Party shall discuss and decide on the punishment of Party members in accordance with these Rules.
The approved establishment of a party group with the authority to appoint and remove cadres to discuss and decide on the punishment of party members shall be implemented with reference to these rules.
The disciplinary inspection and supervision team assigned to the cadre management of the departmental party shall be dealt with with reference to these rules, and the decision shall be made in the name of the discipline inspection and supervision team, or it shall be given to its appointment and removal agency or unit for punishment. Where party discipline and government affairs are given double sanctions, party discipline and government affairs sanctions should be matched and procedures closely linked.
Article 15 The detailed interpretation of these rules shall be undertaken by the General Office of the Provincial Party Committee and the Provincial Commission for Discipline Inspection and Supervision.
Article 16 These rules shall be implemented as of the date of issuance. If the relevant regulations previously issued are inconsistent with these Rules, these Rules shall be implemented.
